Some Relevant DUI Court Decisions May Apply to Your Drunk Driving Case

  • Michigan Department of State Police vs. Sitz, 496 U.S. 444 (1990) – The Michigan case, which was decided by the U.S. Supreme Court, addressed the constitutionality of using DUI checkpoints along selected state roads to apprehend drunk drivers and explored the constitutional protection against unreasonable search and seizure.
  • People v. Anstey, 476 Mich 436, 719 NW2d 579 (2006)  — The case weakened the rights of drivers charged with OWI or alcohol-related offenses to have independent chemical testing under Michigan’s Implied Consent Law. Such tests may help build a strong defense for a DUI-charged driver.
  • People v. Amine,_Mich App (Unpub, #294345, 12/21/2010) — The recent 2010 case decided by the Michigan Court of Appeals allowed the introduction of evidence about prior drunk driving convictions of the defendant under certain circumstances. The case involved a driver charged with OWI 3rd offense who claimed someone else was driving.
  • People v. Vandervliet, 444 Mich 52, 74; 508 NW2d 114 (1993)—The decision established a three-step process for deciding whether to admit into evidence previous drunk driving convictions to avoid introduction of prejudicial evidence.
  • Miranda v. Arizona, 384 U.S. 436 (1966)—This landmark constitutional case dealt with the use of statements obtained from suspects during police interrogation. It requires police to advise a defendant, such as an arrested drunk driver, of their “Miranda” rights, including the right to remain silent and not incriminate oneself and the right to have a DUI defense lawyer present during questioning.
