What is the Super Drunk Law?

Michigan’s so-called Super Drunk law is a new legal definition of drunk driving that applies to drivers who have a bodily alcohol content (BAC) of .17 or higher—more than twice the legal BAC limit. The law prescribes more severe penalties for first-time DUI drivers with a high BAC, including an automatic one-year license suspension, a one-year breath ignition interlock requirement, and up to 180 days in jail. The Super Drunk law also requires convicted drivers to undergo a year-long alcohol rehabilitation program.

A driver required to have an interlock breath ignition device must pay for the installation of the device and monthly maintenance fees. The convicted Super Drunk driver is required to breathe into the ignition device before their vehicle will start. The device will not allow the car to be started if it senses .025 grams of alcohol per 210 liters of breath —the equivalent of one drink — or more. The device records the date and time of each test.
